Resolution Options

Supportive measures

The Title IX coordinator can assist with supportive measures to mitigate the impact of sexual sexual harassment and sexual misconduct.

Supportive Measures are non-disciplinary, non-punitive individualized services offered as appropriate, as reasonably available, to an individual impacted by an incident (such as complainants, respondents, and witnesses) that might fall under the CalArts Title IX Policy or the CA Sexual Misconduct Policy. Such measures are designed to restore or preserve equal access to the Institute’s education program or activity without unreasonably burdening the other party, including measures designed to protect the safety of all parties or the Institute’s educational environment.

Supportive measures are available regardless of whether or not the complainant chooses to report full details (such as the name of the respondent) to the Institute or file a formal complaint with the Institute.

What can be provided:

  • Academic adjustments (changes in section, changes in TA, changes in a class)
  • Academic support (more time for an assignment or a test, late withdrawal, etc.)
  • Changes to on-campus housing situation (room, dorm)
  • Changes in work schedules
  • Campus safety escort
  • No contact directives
  • Change of an advisor
  • Additional measures can be provided depending on the needs of the person and details of their concern

Alternative Resolution Process

The alternative resolution process is designed to eliminate the prohibited conduct, prevent its recurrence, and remedy its effects in a manner that meets the needs of the complainant while still maintaining the safety of the overall campus community.

The alternative resolution process will only be used at the request and agreement of both the complainant and respondent and under the direction of the Title IX coordinator. Requesting an alternative resolution process does not automatically guarantee that the request will be granted even with the agreement from both parties.

The Title IX coordinator will evaluate each case individually to assess whether alternative resolution is appropriate. The Title IX coordinator will review the matter to the extent necessary. This review may include consultation with appropriate Institute employees and seeks to ensure that agreement to an alternative resolution process was without pressure or compulsion from others. The alternative resolution options available under this policy recognize:

  • Participation in this process is voluntary, and either the complainant or respondent can choose to end the process at any time prior to signing the agreement.
  • CalArts can also choose to stop this process whenever either party is no longer displaying the intention of addressing harm and restoring trust or if the details of the complaint fundamentally change and result in a different policy violation.
  • Both the complainant and respondent must participate in individual conference meetings with appropriate staff to learn more about the resolution process prior to participating.
  • The process can only be used once and will not be considered if requested by a repeat respondent under the Title IX policy.
  • Any agreements that are reached during the alternative resolution process must be documented, signed by the complainant and respondent, and approved by the Title IX coordinator.
  • If either party or the Institute choose to stop the process, or if no agreement is reached, the matter may be referred to the Title IX coordinator for further action.
  • When parties agree, the agreement is then included in the conduct record and both parties are held accountable to that agreement.
  • Parties may be charged with failure to comply under the Student Code of Conduct for failure to meet the requirements laid out in the agreement.
  • All parties can be accompanied by a support person at any meeting during the alternative resolution process.

Formal Investigation and Hearing Process and Procedures

The Director of Community Rights and Responsibilities ensures that CalArts responds to all reports of misconduct and retaliation in a timely, effective and consistent manner. The responding team is trained to coordinate the review, investigation and resolution of all reports to ensure consistent responsiveness. Team members pursue interim remedies and accommodations to support the people involved, to protect the CalArts community and to build a culture of respect and accountability.

The Institute recognizes that reporting allegations of sexual misconduct — or not — is a personal decision, and that there are many barriers, both individual and societal, to reporting. Not every individual will be prepared to make a report to CalArts or to law enforcement, and individuals are not expected or required to pursue any specific course of action.

Complainants have specific rights at CalArts, including the rights to be treated with dignity and to receive support where available; to be free of any suggestion that they’re at fault for conduct violations; and to describe alleged misconduct to as few CalArts representatives as practicable. Complainants may choose to report to local law enforcement or state police instead of reporting to the Institute. Further, complainants have a right to be free from retaliation, to have an impartial investigation and to have an advisor of their choosing.

Upon receipt of a report, CalArts may impose reasonable and appropriate supportive measures designed to eliminate the hostile environment throughout the investigation. Supportive measures are available to both the complainant and the respondent. The Institute maintains consistent contact with the parties to ensure that all safety, emotional and physical well-being concerns are addressed. Supportive measures may be provided regardless of whether formal conduct charges or corrective actions are sought by the complainant or the Institute.

Early in the review process, the Title IX coordinator schedules an intake meeting with the complainant. The goal there is to provide the complainant a general understanding of the policy and process; determine if the complainant wishes to address the matter through the process available at the Institute; and to identify forms of support available and appropriate for the complainant.
